Our goal is to provide a simple, enjoyable and fair experience for everyone selling their pre-loved fashion and accessories through our store. By booking a rack, participating in our Designer Pieces program or using any Pre-Loved Aqua Living services, you agree to the following Terms & Conditions. These Terms & Conditions are designed to protect both sellers and Aqua Living while ensuring a positive experience for everyone involved.

General Conditions

1. All information provided to Aqua Living is treated as confidential and used only for the management of your account and sales.
2. Aqua Living reserves the right to amend or update these Terms & Conditions at any time without notice.
3. All items are left in-store at the owner's risk.
4. Aqua Living takes reasonable measures to protect items from theft and damage, however accepts no responsibility for loss, theft, fire, water damage, vandalism, accidental damage or any circumstances outside of our control.
5. Aqua Living reserves the right to rearrange store layouts, displays, racks and merchandising areas at any time.
6. Aqua Living reserves the right to refuse, remove or decline any item deemed unsuitable for sale.
7. By participating in Pre-Loved Aqua Living, sellers acknowledge that they are the legal owner of all items offered for sale and have the right to sell those items.

Rack Rental Pricing

The minimum rack rental period is 2 weeks.

Classic Rack

• Up to 50 coat hangers
• Up to 3 pairs of shoes
• $80 per week

Premium Rack

• Up to 70 coat hangers
• Up to 5 pairs of shoes
• $100 per week

A 25% commission applies to all sales.

No commission will be charged if your total sales for the rental period are less than $200.

Rack rental fees must be paid in full prior to the commencement of the booking and cannot be deducted from sales proceeds.

Designer Pieces by Pre-Loved Aqua Living

Our Designer Pieces program is designed for premium handbags, shoes, sunglasses and accessories.

Designer Cabinet Terms

• No rack hire fee applies
• A 30% commission applies to all sales
• Items are displayed within locked glass cabinets
• Designer items must be authentic
• Aqua Living may request proof of authenticity
• Aqua Living reserves the right to decline items that do not meet our standards
• Designer items are accepted at the discretion of Aqua Living
• Maximum 3 items per seller at any one time
• Minimum sale value of $50 per item
• Minimum booking period of 2 weeks

Designer items remain the responsibility of the seller and are left in-store at the seller's risk.

Accepted Brands & Quality Standards

Pre-Loved Aqua Living focuses on quality fashion, lifestyle and designer pieces that align with the Aqua Living customer.

While we welcome a broad range of brands, we generally do not accept fast-fashion or discount department store labels, including but not limited to Kmart, Target, Big W and Best & Less.

Our goal is to create a curated shopping experience featuring quality brands, timeless pieces and well-presented garments that offer value to both sellers and buyers.

Aqua Living reserves the right to decline any items that do not align with the quality, presentation or brand standards of the store.

Seller Responsibilities

All items must be:

• Clean and freshly laundered
• Clothing must be steamed or ironed before being placed on the shop floor
• In good condition
• Free from excessive wear, stains, holes, pilling or damage
• Genuine and legally owned by the seller

Aqua Living reserves the right to remove items that do not meet our standards.

Items must be tagged using the Zellr system provided by Aqua Living.

Items without valid tags cannot be sold.

Designer replicas, counterfeit items and unauthorised copies are strictly prohibited.

Sales & Pricing

Sellers determine their own pricing and are responsible for ensuring prices are entered correctly into Zellr.

Aqua Living reserves the right to review pricing prior to items being placed on the shop floor and may recommend price adjustments where items are considered significantly over or under market value.

Any pricing changes will be discussed with the seller before items are displayed for sale.

If a seller wishes to change pricing during their rental period, prices must be updated through Zellr and new tags generated where required.

Pre-Loved items are independently priced by each seller and are not automatically included in Aqua Living retail sales, promotions or discount events unless otherwise agreed.

Online Sales & Shipping

From time to time, Aqua Living may promote Designer Pieces through social media, email marketing, website listings and other marketing channels.

If a Designer Piece is sold to a customer requiring shipping, the customer will be charged the applicable shipping fee at checkout.

Aqua Living will arrange packaging and shipment of the item. A handling and shipping administration fee of $9.95 will be deducted from the seller's proceeds for any Designer Piece requiring postage.

Aqua Living is not responsible for delays, loss or damage caused by third-party shipping providers once an item has been dispatched.

Top-Ups & Restocking

To ensure a fair and consistent experience for all sellers, additional stock beyond the allocated rack capacity is not permitted.

Maximum rack capacities are:

Classic Rack

• Up to 50 coat hangers
• Up to 3 pairs of shoes

Premium Rack

• Up to 70 coat hangers
• Up to 5 pairs of shoes

Sellers are welcome to replace sold clothing and shoes throughout their rental period. However, the total number of garments and pairs of shoes on the rack must not exceed the allocated rack capacity at any time.

Racks must not be overfilled. Aqua Living reserves the right to remove excess items where required.

Returns, Exchanges & Refunds

All sales of pre-loved items are final.

Due to the nature of pre-loved and consignment goods, Aqua Living does not offer refunds, exchanges or change of mind returns on any pre-loved purchases.

Customers are encouraged to carefully inspect all items prior to purchase.

Where a pre-loved item has a fault that was not disclosed at the time of sale, Aqua Living may, at its sole discretion, contact the seller to discuss a suitable resolution. Any refund, exchange or store credit remains at the discretion of Aqua Living and the original seller.

Designer Pieces, handbags, shoes, sunglasses and accessories sold through Pre-Loved Aqua Living are also sold on a no refund and no exchange basis.

This policy does not affect any rights customers may have under Australian Consumer Law.

Collection of Unsold Items

All unsold items must be collected by the agreed collection date at the end of the rental period.

If items are not collected within 7 days of the rental ending, Aqua Living reserves the right to charge a $20 per day packing and storage fee.

Items not collected within 30 days may be donated, sold or otherwise disposed of at Aqua Living's discretion.

Missing Tags & Unidentified Items

Items found without tags will be held separately.

It is the seller's responsibility to regularly check and identify missing-tag items.

Items remaining unidentified for more than 30 days may become the property of Aqua Living.

Payments

Sales proceeds are paid directly to the seller's nominated bank account.

Payments are processed within 7–14 business days following the completion of the rental period.

It is the seller's responsibility to provide accurate bank account details.

Aqua Living accepts no responsibility for payments made to incorrectly supplied bank account details.

Marketing Permission

By participating in Pre-Loved Aqua Living, you grant Aqua Living permission to photograph, film and promote your items through:

• Social media
• Email marketing
• Website listings
• Advertising campaigns
• Other promotional channels

No compensation is payable for the use of such content.

Prohibited Items

The following items are not permitted:

• Counterfeit or replica goods
• Stolen items
• Weapons
• Dangerous goods
• Illegal substances
• Adult products
• Food or grocery items
• Furniture
• Any item deemed unsuitable by Aqua Living

Any suspected counterfeit or illegal items will be removed immediately.

Acceptance

By booking a rack, participating in the Designer Pieces program or selling through Pre-Loved Aqua Living, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
